PERSONAL PROPERTY AUCTION TERMS & CONDITIONS
On behalf of Crescent Auctions, thank you for registering and participating in our auction. We deeply appreciate your interest and engagement in our process. To ensure your experience is smooth and enjoyable, please take a moment to review the key terms governing our auction:
REGISTRATION PROFILE: By completing registration, the bidder confirms they are at least 18 years old and possess the legal capacity to place bids. If bidding on behalf of a partnership, corporation, limited liability company (LLC), third-party agreement, or joint venture, the bidder affirms they have the authority to enter into contracts on behalf of the entity.
ACCURATE INFORMATION: You must provide complete and accurate registration details, including your name, email address, and payment information. You may be asked to provide identification for verification purposes.
AUCTION TERMS: Items are sold “as-is,” and all sales are final. No refunds or exchanges will be issued after items are removed. Pickup or mailing is at the buyer’s expense. It is the buyer’s responsibility to inspect items and verify descriptions before placing bids. You are welcome to schedule a time to preview the items prior to bidding. PAYMENT: Payment, including a 13% buyer’s premium and applicable taxes, is due within 48 hours of the auction’s close. Failure to pay may result in forfeiture of items and suspension from future auctions.
BATCH RUN CREDIT CARDS: By registering, you authorize the auctioneer to charge your credit card for the full amount due, including the item price, buyer’s premium, taxes, and fees.
PICKUP: Pickup must be scheduled using the emailed link https://calendly.com/sellcrescent/crescent-auctions. All items must be picked up at the buyer’s expense, risk, and liability. Items will be released only upon payment in full. If items are not removed within the specified time, the auctioneer may remove, store, or resell them at the buyer’s expense. Items not collected within seven days will be considered abandoned and maybe resold without refund.
BIDS: The auctioneer reserves the right to remove or cancel bids, counterbid, suspend bidding privileges, or take any other actions deemed necessary to protect the seller’s interests.
ABSENTEE BIDDING: Qualified bidders may submit proxy bids, indicating the maximum amount they are willing to pay. This bid becomes binding offer at the stated amount.
BUYER'S PREMIUM: A 13% buyer's premium, based on the total purchase price.
UPDATES: Auction terms may change. By participating, you accept the most current terms. By continuing to participate after updates are posted, you agree to be bound by the revised terms.
INDEMNIFICATION: Crescent Auctions is not responsible for technical platform issues or discrepancies in item descriptions.
RESERVE PRICE: Some items may have an undisclosed minimum bid requirement.
ITEM MODIFICATION: The auctioneer has the right to add, remove, or modify items without prior notice. The auctioneer may reject any bid at their discretion and withdraw items if necessary.
DISPUTE RESOLUTION: The auctioneer’s decision is final regarding any disputes related to winning bids or other auction matters.
SALES TAX: Applicable taxes will be charged unless a valid tax-exempt certificate is provided before the auction closes. Local and State sales tax will be applied
WARNING: False bidding is a criminal offense under U.S. law as outlined by the Department of Justice.

JURISDICTION & VENUE: Should litigation arise from the sale of this property, those claims shall be brought in Dallas County, Texas. The parties agree to mediation before pursuing litigation.
